Yet Another Reckless Lawsuit Suffers Defeat

U.S. District Judge Jerome B. Simandle dismissed Camden County's
(N.J.) reckless lawsuit against 11 gun manufacturers last week,
stating the county failed to state "legally actionable claims."
Camden's suit claimed that a total of 21 gun manufacturers - all of
which are subject to strict federal, state, and local laws
regulating the production and distribution of their
products - should be held financially accountable for the criminal
misuse of firearms. The suit alleged the gun makers were
negligent in the marketing and distribution of firearms, and that
gun makers created a public nuisance.
Judge Simandle, however,
found the county's suit "lacks constitutional standing," and that
the 11 manufacturers "may not be held liable for creating or
maintaining the public nuisance of which Camden County
complains."
Ten of the companies named in the suit did not join
in the motion to dismiss the lawsuit, and remain, for the time
being, as defendants. Camden County Counsel Robert G. Millensky
stated the county Board of Freeholders will consider appealing
this decision.
